1. Acceptance of Terms

By accessing or using ListingSpark ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ListingSpark provides AI-assisted real estate listing description generation, social media caption creation, and related tools for licensed real estate professionals and their teams.

3. Account Registration

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Free Trial and Paid Plans

• Free Trial: Includes a limited number of listing generations. No payment required.
• Pro Subscription ($15/month): Unlimited generations with a monthly recurring charge. Cancel anytime; access continues through the end of the billing period.
• Lifetime Access ($99 one-time): Unlimited generations with a single payment. No recurring charges.

Prices are subject to change. Founding members who purchase before public launch will retain their original pricing for the duration of their subscription.

5. Payments and Refunds

Payments are processed securely through Stripe. All sales are final. If you experience a technical issue preventing use of the Service, contact support for a resolution. Refund requests are handled on a case-by-case basis within 30 days of purchase.

6. Your Content

You retain ownership of all property information, photos, and data you submit to the Service. ListingSpark does not claim ownership of your content. By using the Service, you grant us a limited license to process your content solely to provide the Service.

7. Generated Content

Listing descriptions, captions, and other outputs generated by the Service are provided for your use. You are solely responsible for reviewing all generated content for accuracy, compliance with local MLS rules, Fair Housing Act requirements, and brokerage policies before publishing.

8. Fair Housing Compliance

ListingSpark includes fair-housing-aware language guidelines. However, the Service does not guarantee full legal compliance. You are responsible for ensuring all published content complies with the Fair Housing Act, state and local fair housing laws, and your MLS board's rules.

9. Prohibited Uses

You may not:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Resell, redistribute, or sublicense access to the Service without written permission
• Use automated scripts, bots, or scrapers to access the Service
• Interfere with or disrupt the Service's infrastructure

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that generated content will be error-free, legally compliant, or suitable for any specific MLS system.

11. Limitation of Liability

To the maximum extent permitted by law, ListingSpark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

13. Termination

We may suspend or terminate your account if you violate these Terms. You may cancel your account at any time through the account settings or by contacting support.
